Conspiracy Theories: Eminent Domain by Default? – Guest Post

I don’t often make more than more than one post in a day, but we were lucky enough to have two Guest Posts today. “…; nor shall private property be taken for public use, without just compensation.” You have just read the final words of the 5th Amendment of the Constitution of the United States. The Supreme Court has held that the federal and state governments have the authority to seize real property under eminent domain as long as there is just compensation. In the case of the federal gov’t, the public use must correspond with congress’ enumerated powers.
I don’t know if this is true or possible, but with the right angle, a person could contend that the federal gov’t is positioning itself to begin land grabbing through intimidation and greed…all while making it look like we’re helping people and the environment. Sound crazy? Let’s take a look at it.
During the 4 presidential terms that were made up of Clinton and Bush 43, the federal gov’t added incredible regulations to the mortgage industry through FHA, and Fannie Mae and Freddie Mac that lowered the income requirements and loan to value ratios on home buyers and mortgage lenders. These reckless regulations have led to the bursting of the housing bubble, and the current economic recession (and future depression). What these administrations did was expand the federal gov’t under the feel-good theories of liberalism and progressivism. What really happened is what always happens when liberalism and progressivism are implemented…cruelty, failure, job loss, and despair.
As jobs continue to disappear, more and more houses are being lost to foreclosure. Many of them were mortgaged with loans insured by the federal gov’t. Guess who really owns that property now? President Obama has been beating up the banks for doing what the progressives in the gov’t made them do, and the banks have simply stopped lending and are paying back the TARP funds. President Obama has set up a system that will allow those who have fallen behind in their mortgage to refinance up to 110% of the value of the home. Unfortunately, most of the people who need to refinance need much more because their loans were already financed at 125% of the value several years ago, and the property values have plummeted.
So, the federal gov’t is NOT doing what it said it would do by adjusting mortgages so people can get back on their feet. The gov’t now finds itself the owners of countless properties in dilapidated urban areas, and there is word now that these old neighborhoods may be bulldozed down to build parks, or be allowed to be rebuilt by cities and states after they purchase them.
While I don’t disagree that destroying the former crack house neighborhoods and rebuilding the inter-cities is a good idea, the methods the gov’t used to get there are concerning. The FEDERAL gov’t will own this property. The states will be on the leash of the feds.
Until recently, there was very little talk of a back door conspiracy of the federal gov’t to grab land from private citizens in order to control the states. However, under the biggest political lie ever told, (global warming and man-made climate change,) the feds are attempting to do exactly that. The global warming bill just passed by the House will require private citizens that wish to sell their homes to have it “energy efficient.” I am moving to a new house and I’ll be renting my house out because it just isn’t sellable. If I had to make it energy efficient to the standard of the global warming liars, I would need to drop over $10,000 into it for windows and insulation. So when I think about those in the inner city that are struggling to make the payments on their home just so they can sell it, this legislation destroys the lower middle class, and will force many more homes into foreclosure….and the gov’t will own them….then they can sell the property to developers that will pay more taxes than the owners of the homes that used to be on them. Those same homeowners were the ones that were promised help by the current administration in Washington. All of this regulation, and the states, counties and cities have no say in it at all.
While this may be a far out conspiracy theory created by a crack pot in a mold infested and energy inefficient basement, there is only one thing left for the progressives in Washington to say or do that will make me right. If they can control the lending practices, and the foreclosure practices, they will try to control the credit rating practices. When the gov’t begins forgiving loans and saying that it will not affect a persons credit history, we have reached a level of tyranny unimagined in this country…and we’re only one step away from it. The Obama Administration is looking into a loan forgiveness program where a home owner that falls behind on his mortgage could forfeit ownership and become a renter. The federal gov’t will become a land lord. Is anyone paying attention?
